Sagesmask is a Digital Asset platform for commercial use, with premium digital content. We Sagesmask Inc., operate the Sagesmask website at sagesmask.com (the “Site”) and all related websites, software, mobile apps, and other services that we provide (together, the “Service”) with the vision to deliver our digital art for our subscribers. Your use of the Service, and our provision of the Service to you, constitutes an agreement by you and Sagesmask to be bound by the terms and conditions in these Terms of Service.
By accessing or using our website, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our website.
1. About Sagesmask
Sagesmask is a digital asset platform providing premium product mockups and other creative resources for personal and commercial use, depending on the subscription plan selected.
Sagesmask provides access to digital assets through subscription plans. Each plan provides different usage rights, project limits, user limits, and commercial benefits as described on the applicable pricing and license pages.
Your use of Sagesmask assets is subject to:
- These Terms of Use;
- Your active subscription plan;
- The applicable license;
- Any usage limits associated with your plan.
2. Subscription Plans
Sagesmask offers different subscription plans, each with its own features and usage rights.
Your subscription plan determines the rights and limitations applicable to your use of Sagesmask assets.
These may include:
- Personal or commercial use;
- Number of projects;
- Number of users;
- Access to specific designs or the full library;
- Physical product usage;
- Printed advertising;
- Digital advertising;
- Commercial video;
- Social media usage;
- Other features or limitations stated on the applicable pricing page.
Sagesmask may introduce, modify, replace, or discontinue subscription plans or their features at any time.
3. Downloads
Downloads are unlimited while your subscription is active, subject to reasonable technical and security measures.
Unlimited downloads mean that you may download as many available assets as your subscription allows during the active subscription period.
However, downloading an asset does not automatically grant unlimited project usage.
Your use of downloaded assets remains subject to your subscription plan, applicable project limits, and the license terms described below.
Downloading, storing, or retaining a file does not transfer ownership or copyright of that file to you.
4. Project Licensing
Sagesmask uses a project-based licensing system.
A Project means a specific creative or commercial use of one or more Sagesmask assets for a particular client, brand, campaign, product, or purpose.
Multiple Sagesmask mockups used for the same client, brand, campaign, product, or purpose may be considered part of a single Project.
For example:
Using five different Sagesmask mockups to present one brand identity campaign may be considered one Project.
Your subscription plan determines how many Projects you may license during each billing period.
Solo
The Solo plan includes a limited number of Projects per month as specified on the pricing page.
Studio
The Studio plan allows unlimited Projects while the subscription is active, subject to the other limitations and conditions of the plan.
Agency
The Agency plan allows unlimited Projects while the subscription is active, subject to the other limitations and conditions of the plan.
Enterprise
Enterprise usage is subject to the terms and limits agreed upon under the applicable Enterprise plan.
5. Commercial Use
Commercial use is available only with subscription plans that explicitly include commercial rights.
Where commercial use is permitted, you may use Sagesmask assets to create permitted commercial work, including presentations, marketing materials, advertisements, product visualizations, client projects, and other approved uses within your plan.
Commercial usage remains subject to the limits and conditions of your subscription plan.
6. Physical Products
Where permitted by your subscription plan, you may use Sagesmask mockups to present, promote, and market physical products.
The physical product itself must be your own product or a product you are authorized to represent.
Your subscription does not grant ownership of the Sagesmask mockup or any third-party content contained within it.
7. Use After Subscription Cancellation
If you cancel your subscription, your access to the Sagesmask library will end when your current subscription period expires.
You will no longer be able to download new designs or access subscription-only content unless you resubscribe.
Files that you previously downloaded may remain stored on your devices.
However, downloaded files may only be used for Projects that were properly licensed during your active subscription.
You may continue using those assets for those properly licensed Projects after your subscription ends.
You may not use previously downloaded Sagesmask assets for new Projects after your subscription ends unless you resubscribe.
Resubscribing restores access to the applicable library and allows you to license new Projects according to the limits and features of your new subscription plan.
8. Project License and New Uses
A license for one Project does not automatically authorize the use of the same Sagesmask asset for unrelated Projects.
For example:
Allowed:
You use a Sagesmask mockup for a client's branding project while your subscription is active. That Project remains licensed after your subscription ends.
Not Allowed:
You cancel your subscription and later use the same downloaded mockup for a new client's project without an active subscription.
To use Sagesmask assets for a new Project, you must have an active subscription that provides the appropriate rights for that use.
9. Permitted Use
Subject to your subscription plan and applicable license, you may:
- Download Sagesmask assets;
- Modify mockups to present your own designs;
- Use mockups in personal projects where permitted;
- Use mockups in client presentations;
- Use mockups to showcase your work;
- Use mockups in permitted commercial projects;
- Use the resulting presentation or finished work in permitted marketing and promotional materials;
- Use mockups to present physical products where permitted by your plan.
10. Prohibited Use
You may not:
- Resell the original Sagesmask files;
- Share or distribute original Sagesmask files;
- Sublicense Sagesmask files;
- Transfer your rights to another person or organization;
- Upload Sagesmask files to stock websites, marketplaces, file-sharing services, or digital asset libraries;
- Make Sagesmask files available for download by third parties;
- Provide original editable mockup files to clients or other third parties;
- Sell Sagesmask mockups as standalone digital products;
- Use Sagesmask assets to create a competing mockup, template, stock asset, or digital asset service;
- Copy or reproduce the Sagesmask library or collection;
- Remove technical protections from Sagesmask files;
- Use Sagesmask assets in any unlawful manner.
Modification of a Sagesmask mockup does not grant ownership of the original mockup or the right to distribute the modified file as a standalone digital asset.
11. Client Projects
You may use Sagesmask assets in client projects when your subscription plan permits such use.
However, providing a client with the finished presentation or exported result does not transfer ownership of the underlying Sagesmask asset.
You may not provide clients with the original PSD, AI, or other editable Sagesmask files in a way that allows them to independently reuse or redistribute the asset.
If a client requires independent access to the original Sagesmask asset, the client must obtain an appropriate license directly from Sagesmask.
12. Account and User Limits
Your account may only be used by the number of users permitted by your subscription plan.
You may not share your account credentials with individuals or organizations beyond the user limit of your plan.
Where a plan permits multiple users, each user must comply with these Terms and the applicable license.
Sagesmask may restrict or terminate accounts that are found to be sharing access beyond the permitted limits.
13. Intellectual Property
All Sagesmask content remains the property of Sagesmask or its respective content suppliers.
This includes, but is not limited to:
- Mockups;
- Images;
- Templates;
- Graphics;
- Digital files;
- Website content;
- Text;
- Logos;
- Design assets.
Your subscription grants you a license to use applicable Sagesmask assets. It does not transfer ownership or copyright of those assets to you.
14. Third-Party Content
Some Sagesmask mockups may contain trademarks, logos, artwork, photographs, recognizable people, or other third-party materials.
Your Sagesmask license does not automatically grant you rights to use third-party trademarks, logos, brands, artwork, photographs, or likenesses.
You are responsible for obtaining any additional permissions required for your intended use.
15. Payments and Subscription
Subscription fees are charged according to the billing period and pricing selected at checkout.
Your subscription will continue according to the selected billing cycle until cancelled.
You may cancel your subscription at any time through your account.
After cancellation, your access remains active until the end of your current paid billing period unless otherwise stated.
16. Refunds
We do not offer refunds. Please read the information carefully or contact us before purchasing. If you need any additional information, don't hesitate to contact us before making your purchase.
17. Account Termination
Sagesmask may suspend or terminate an account if you:
- Violate these Terms;
- Misuse Sagesmask assets;
- Share or redistribute Sagesmask files;
- Resell Sagesmask assets;
- Circumvent usage restrictions;
- Share an account beyond the permitted user limit;
- Engage in fraudulent activity;
- Attempt to obtain unauthorized access to Sagesmask systems;
- Otherwise abuse the Service.
If an account is terminated due to a violation of these Terms, any licenses associated with the account may also be terminated to the extent permitted by applicable law.
18. Changes to the Service
Sagesmask may modify, update, suspend, or discontinue any part of the Service, including:
- Digital assets;
- Library availability;
- Subscription plans;
- Pricing;
- Features;
- Usage limits;
- Website functionality.
Sagesmask may also update these Terms from time to time.
The latest version of these Terms will be published on this page.
19. Disclaimer
Sagesmask provides its digital assets and services on an "as available" basis.
While we make reasonable efforts to maintain the quality and availability of our Service, we do not guarantee that the Service or any particular asset will always be available, uninterrupted, or error-free.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Sagesmask shall not be liable for indirect, incidental, special, consequential, or other damages arising from or related to the use of the Service or Sagesmask digital assets.
